Earthsong Nature Programs for children are for children of all ages and are currently being offered at private properties and various reserves, parks, venues and beach locations across the Mornington Peninsula. Children participate in our holistic nature programs in diverse natural environments surrounded by a variety of natural elements, different landscapes, wild flora and fauna. Earthsong Nature Programs are a term commitment and investment. By enrolling in and booking your child/children into any of Earthsong Nature programs you are giving consent for your child/children to participate in our outdoor nature programs and agree to be bound by the following terms and conditions:

Earthsong Nature Programs take place outdoors, in a natural environment. Whilst we always endeavour to maintain a safe environment for children participating in our programs, you understand and are fully aware that there are associated risks associated with being outdoors in a natural environment. These risks can include, but are not limited to, insect bites, scratches, splinters, snake bites, serious bodily injury, drowning, sunburn and loss or damage to personal property that is brought to the program. It is your responsibility to support and agree to the safety guidelines as per the directive of our facilitators. Understanding the potential associated risks whilst being outdoors participating in one of our programs, we will have no responsibility to pay for any medical treatment and any related costs if you or child is injured. We also disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose. Knowing the risks described above, you agree, personally and on behalf of your child/children to assume all the risks and responsibilities surrounding your child/children’s participation in our programs.

To the fullest extent allowed by law, you hold harmless and agree to indemnify all of our staff and employees, assistants, property owners, directors, faculty, volunteers, and agents, from and against any present or future claim, cause of action, loss or liability for injury to person or property, which you or your child/children may suffer or for which you or your child/children may be liable to any other person, related to you or your child/children’s participation in recreational activities operated by us, resulting from any cause whatsoever, and regardless of fault. All references to “we”, “us” or “our” means Earthsong Nature Programs ABN:57267535618

You warrant that you are at least eighteen years of age, that you are the parent/legal guardian of the child for which you have enrolled and that you (or a designated adult) will be the carer supervising your child’s participation in our bush programs. You understand and agree that no oral or written representations can or will alter the contents of these terms. You agree that these terms and conditions shall be governed by the laws of Victoria, Australia.

Please ensure that you disclose on your enrolment form if your child has additional needs, physical, social, emotional or challenging behaviours that will require additional adult support. Please disclose if your child has any major illnesses or prior injuries that could affect your child’s or other children’s ability to participate in the program. The safety and well-being of the staff and children during sessions is a priority. Should your child enrol and exhibit behaviours that effect the safety and wellbeing of Earthsong staff and/or children, management will execute their right to cancel your place in the program and offer no refund.

 

Absences, Cancellation and Refund Policy

By enrolling in one of Earthsong’s Nature Programs you agree with and have read our Absences, Cancellation and Refund Policy. When you purchase and enrol your child/children in an Earthsong Nature Program you are making a commitment and entering into a contract where the following absence, cancellation terms and refund policy applies. The following policy explains what your enrolment and purchase gives you, including refunds and compensation if we or you have to cancel.

Absences, Cancellation and Refund Policy

If Earthsong Nature Programs cancel a session due to dangerous weather or any other unforeseen circumstances, we will offer one of the following options:

• Offer you a makeup session.

• Give you credit for the session missed (to be used within 12mths from the date of issue).

• Please note: If a session is cancelled after it has already started due to weather or safety concerns, we are unfortunately unable to give a refund or credit of the session fees.

If Earthsong Nature programs cancels a full-term program (due to minimum numbers not being met or for any other reason then, you are entitled to a full refund, or we will offer you the choice of another program or credit).

If your child/children can’t attend one or more sessions during a term program. If your child/children cannot attend one or more sessions due to being unwell or for any other reason, then we do not offer a refund, credit or make-up session as that spot has been held for you and the program planning and staff member/members allocated to work that day, and resources purchased has been based on the number of children attending. This also applies to any one-off Earthsong workshops, special events, or sessions.

 

If you want to cancel (full term)

If an Earthsong Program has not been cancelled, but you change your mind or are unable to continue, then you’re not entitled to a refund under Australian Consumer Law. Under our permit licence, we can only accept a certain number of families per group so that spot has been allocated to you and with short notice, we are often unable to fill positions. This includes any Earthsong Workshop or one-off events where we cannot offer credit or make up sessions.

If you have booked into a full-term program and your circumstances have changed and you cannot attend, then the following options are available:

• If you cancel 7 days before the commencement of a term program then we can give you a refund minus a 20% admin fee.

• If you cancel with less than 7 days’ notice, we will give you a refund minus 30% admin fee.

• If you cancel on or after the first day of term has commencement, then we cannot offer a refund.

Earthsong Nature Programs will endeavour to process all refunds within 2 – 6 weeks of such circumstances becoming known, and the amount will automatically go back into the same account that you paid with. Once your enrolment and booking has been cancelled, you will receive a notification email.

Earthsong doesn't offer trial days/sessions but may have information nights or casual session workshops.
